Content Creator Agreement

TERMS AND CONDITIONS FOR CONTENT CREATORS

This Terms and Conditions agreement (the “Agreement”) is made and entered into by and between Stacks Creative LTD, a company incorporated under the laws of Ireland, with its registered office at [Your Address] (“the Agency”) and the content creator (“the Creator”) who fills in the form to provide personal information to the Agency.

By submitting personal information to the Agency, the Creator agrees to be bound by the terms and conditions of this Agreement. The Creator acknowledges that they have read this Agreement and understand its contents.

1. Personal Information

The Agency will collect and process the Creator’s personal information in accordance with the General Data Protection Regulation (GDPR). The personal information collected by the Agency may include the Creator’s name, email, phone, social media details, social media profiles, files of their past work, interests, pricing rates and other details relevant to the selection process.

2. Use of Personal Information

The Creator’s personal information may be used by the Agency primarily for the purpose of creating social media campaigns and content creation for clients and third parties. However, the use of the information is not limited to these purposes and may be used for other purposes in the future. The Creator agrees that the Agency may share their personal information internally with its employees, contractors and partners as necessary for the selection process and for the purpose of creating social media campaigns and content.

3. Opt-in and Withdrawal of Consent

By filling out the form, the Creator consents to the Agency collecting and using their personal information as described in this Agreement. The Creator may withdraw their consent at any time by sending an email to info@stacks.ie requesting the deletion of their personal information. The Agency will respond to the Creator’s request within 30 days.

4. Security

The Agency will take appropriate measures to ensure the security of the Creator’s personal information, including the use of encryption, firewalls, and other technical measures. The Agency will also take appropriate organizational measures to ensure that employees and contractors are aware of their responsibilities with regard to data protection.

5. Disclaimer

The Agency will use its best efforts to ensure that the personal information collected from the Creator is accurate, complete, and up-to-date. However, the Agency does not guarantee the accuracy or completeness of the Creator’s personal information.

6. Limitation of Liability

The Agency will not be liable for any damages, losses, or expenses arising from the Creator’s use of the Agency’s services or the Creator’s personal information, except in cases of gross negligence or willful misconduct.

7. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of Ireland. Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the Irish courts.

8. Entire Agreement

This Agreement constitutes the entire agreement between the Agency and the Creator with respect to the subject matter hereof and supersedes all prior agreements and understandings, whether written or oral.

By checking the opt-in box and submitting the Content Creator form, the Creator acknowledges that they have read, understood, and agreed to the terms and conditions of this Agreement.
